OLD LYME ZONING COMMISSION
MINUTES OF THE PUBLIC HEARING
Monday, August 9, 2004


The Old Lyme Zoning Commission held its Public Hearing on Monday, August 9, 2004, in the auditorium of Memorial Town Hall.  Members present were Ted Kiritsis (Chairman), Jane Marsh (Secretary), Tom Risom, Joan Bozek (arrived at 7:35 p.m.), Eric Fries (arrived at 7:39 p.m.) and Howard Tooker (Alternate).  Also present was Ann Brown, Zoning Enforcement Officer.

The Public Hearing convened at 7:31 p.m.  


1.      Site Plan Application to construct offices/workshop, 57 Four Mile River Road, Peter Mountzoures, applicant.  

Ms. Marsh noted the new Exhibits (O & P) for the record.  She noted that the new site plan dated August 6, 2004 and a letter dated July 31, 2004 from Tom Metcalf should also be added to the exhibit list.  Ms. Marsh read the letter of approval from the Conservation Commission.

Joan Bozek arrived at this time (7:35 p.m.).  Chairman Kiritsis noted that Mr. Tooker would remain a voting alternate.  Ms. Bozek noted that she is not eligible to vote in this matter as she was not at the July Public Hearing and has not listened to the tapes.

Dave Coonrod was present to represent the applicant.  He explained that he received comments from Tom Metcalf and made corrections to the plans accordingly.  Mr. Coonrod stated that he received a final comment from Mr. Metcalf today at noon, and has revised the plans accordingly.  He noted that Mr. Metcalf’s letter dated August 9, 2004, addresses the driveway servicing Mr. Carpentieri.  Mr. Coonrod submitted a copy of a contract that indicates that as long as Pete owns the land to the south of this property, he will pass and repass over the parking lot in the commercial building.  He noted that if and when the property is sold, a new driveway would have to be constructed to service the house lot.




Mr. Coonrod stated that all of the other minor comments of Mr. Metcalf have been addressed.  He explained the landscaping on the south side of the property, noting that they will maintain the existing trees and fill in with pine trees.  Mr. Coonrod stated that for lighting they are proposing a cluster type light that points down.  He noted that there are three of these lights on the building for security in the parking lot.

Mr. Conrood stated that he believes all issues have been addressed, Wetlands has given their approval and the Health Department has granted approval.  He indicated that he believes all comments and issues have been met.  

Mr. Fries arrived at this time (7:39 p.m.).  Mr. Fries noted that he is not eligible to vote on this item as he was not at the July Public Hearing and has not listened to the tapes.

Ms. Brown noted that there was a sign design submitted and she does not believe it meets the Regulations.  She suggested that a condition of approval be that the sign be handled in a separate application with a separate approval.

No one present spoke in favor or against the application.  Hearing no further comments, Chairman Kiritsis asked for a motion to close the Public Hearing for this application.

A motion was made by Tom Risom, seconded by Jane Marsh and voted unanimously to close the Public Hearing for the Site Plan Application to construct office/workshop, 57 Four Mile River Road, Peter Mountzoures, applicant.


2.      Site Plan/Special Exception Application to enlarge automotive repair facility, 147 Boston Post Road, All Pro Automotive, applicant.

Ms. Marsh noted the new exhibits:  July 13, 2004 letter from Tom Metcalf and Wetlands Commission report dated August 9, 2004, which was read for the record.

Mr. Hendriks was present to represent the applicant.  He explained that the applicant has addressed all of Mr. Metcalf’s concerns in the revised plans, which were marked Exhibit U.  Mr. Hendriks noted that Mr. Metcalf’s letter indicates that the plans satisfactory address the comments of the Wetlands Commission.

Ms. Brown suggested that the sign design be approved by a separate permit.  Mr. Hendriks noted that the signs exist and they are not adding new signs with the exception of the 4’ x 6’ sign that says All Pro Automotive.

No one present spoke in favor of or against this application.  Hearing no further comments, Chairman Kiritsis asked for a motion to close the Public Hearing for this item.




A motion was made by Tom Risom, seconded by Jane Marsh and voted unanimously to close the Public Hearing for the Site Plan/Special Exception Application to enlarge automotive repair facility, 147 Boston Post Road, All Pro Automotive, applicant.

The Public Hearing adjourned at 7:50 p.m.
